Louisiana legal HELP!!!!

    some up setting news. on the import paperwork they say for off road use only. From what I understand so far is that if it is tagged that way you can't get it legal for the road in LA. There was a sentence in the wordage I over looked. "If files are submitted on used mini trucks and only a bill of sale is presented, please request that the person obtain paperwork that indicates that the vehicle was either manufactured in this contry or was imported for use on highways.". It would seem that the DMV throw us a sucker punch. I am wondering if you can bring the trucks into applance with the EPA, DEQ, and DOT. If I could do that than it would be good to go, I am thinking.
    Maybe once I get the BOL it wont have have that or the lady at the desk wont notice it.

    If this does turn into a "Mission Impossable" type of thing to do in the state of La, couldnt you just get a PO box in the state of Oklahoma and tag it with an Okla tag?? This isnt illegal, trucking compaines from different states have been doing this for years, for tax reasons, so why cant you do this for the mini trucks? Apparently the state of Oklahoma doesnt mind the extra money.

    would you need a OK drivers licence? what about tags/inspections, I don't want to go up to OK every year. I don't know if that would work but it is looking into, I would probbly do it in Mississippi though.

    OK, I live in Louisiana and am no legal eagle or anywhere close but, I once had a problem with the DMV on a car title and finally solved it by seeing a Justice of Peace. It cost $75 but EVER HOW THEY RULE is accepted by the State without question. May be another angle to approach. FWIW

    I don't think you have to have an Okla drivers license to buy an Okla tag, but I'll call a tag office tomorrow and find out for sure. I do know what you have to have some sort of an address, so a PO box will work. that I do know for sure.
    We dont have inspections here in OK, we used to untill the former govoners wife got a ticket for having an expired inspection sticker on her windshield. :D True Story!

    OK, will not care, but La. definitely will:D

    If you live in La., it will have to be registered in La. You may get by with it for a little while. but you WILL finally get caught. The ONLY option will be to register it in La., IF you intend to drive on the hwy.

    I will be getting the customs paperwork today so I will see what it has on it. if it has the not for road use on it the only thing I can do is take it to the DOT and EPA/DEQ and have them inspect it so they can slap a cert. sticker on it.

    Just curious, where are you getting the info that DOT, EPA, DEQ, can do ANYTHING to counter the 'not for road use' designation.

    It is my understanding that since the rules on importation stipulated 'off road only', nothing could change that...........although some states are ignoring it and registering them:confused:

    arizona wouldn't recognize any of the paperwork i had to register it for on road or off road. i went out of state and had a friend register it... now it has a title to register in arizona as an atv. atv's are legal on the roads in arizona if compliant with windshield, lights, signals and horn.

    i found a dealer here in arizona who has all of his trucks for sale with a title and registration as atv's from arizona... he uses all the same paperwork i had, but they wouldn't do it for me... :frustration:

    Thats the reason for having the PO Box in Oklahoma..... I didnt get a chance to call a tag office today,......... ok, actually I had just forgot about it.....:rolleyes:......but I will! Then we'll know if I am indeed crazy or not :D

    The address in OK, will not matter. You still will be caught. These minis are not inconspicuous. If you live in La. or stay in La. over 50% of the time, you MUST have La DL, and any veh. in the state 50% of the time, must be reg. in La. It is NOT hard to determine your residence.

    I just dont see how this would be illegal? Last time I checked Okla license plates are good in 50 states, Mexico and Canada. Also, I've never heard of someone getting a ticket for driving with a current out of state tag. :rolleyes:

    I did call my local tag office here today and asked them if a person had a PO Box in Oklahoma and an out of state drivers license, can they buy an OK license plate? The lady said yes So it looks like come November 1st "when mini's become legal in OK" you could tag your mini this way.

    Again, Ok, nor any other state minds taking your $$. The problem will be, that Law Enforcement in La. will not let it slide. It is VERY easy to find that the driver lives in La. If a simple warning/ticket does not get the desired results, the vehicle can be towed and held until it is registered in La.

    Maybe I'm way out in left field on this........but I really dont think so. Perhaps you could explain why trucking compaines do this exact same thing, and have been for years? Just as an example, my uncle ran a trucking company in Arkansas, had a PO box just across the state line in Ok and had all of his trucks tagged in Okla because the tags were several hundred $$'s cheaper than the Ark tags. And did this for 25+ years.

    Also, do you mean that if I drive my Okla tagged & registered minitruck in the state of La. or any other state that I would be ticketed and have my truck impounded? I'm really not just arguing for the sake of arguing, just trying to figure all of this out. :frustration:

    This is from the Arkansas DMV sight.

    Vehicle Registration if Moving from Another State
    You have 30 calendar days after becoming a resident to register your vehicle in Arkansas. Applications can be made in any state revenue office.

    I interpret that to mean you can drive around with Oki tags for 30 days. After that you could be sighted for not registering your vehicle in Arkansas.

    Insurance companies operate similary. They want to provide insurance rates based on where the vehicle is operated and/or registered.

    OK DMV Insurance Requirements.

    MV: Liability Insurance Verification
    Unless otherwise provided, proof of liability insurance coverage must be submitted upon the registration of every motor vehicle. Such proof will ordinarily be in the form of an insurance security verification form, which must contain the following:

    Name and address of the carrier
    Name and address where security may be verified, if other than the carrier
    Name of the insured
    Notice that an owner’s policy has been issued pursuant to the Compulsory Insurance Law of Oklahoma.
    Year, make and at least the last three (3) digits of the VIN of each insured vehicle. Fleet insurance is exempt from this requirement.
    Inclusive dates (beginning and ending date) the liability policy is in effect
    A warning to the owner that state law requires one (1) copy of the verification form to be surrendered upon registration and one (1) copy to be carried in the vehicle.

    My thoughts are you will run into problems with your insurance company and quite possably law inforcement in your state. Fraudulant actions with insurance companies can create significant problems. Just not worth the :frustration: headaches :frustration: in my opinion.

    Not trying to be a smart @ss :sly: but why don't you ask your Uncle this question and let us know what he says. I am not familiar with state nor federal trucking regulations. However, it is not uncommon to see trucks from different states with trailers from different states depending on if they are an in state or national trucking company.

    Just my thoughts.

    I was half asleep when I posted that info. This is from Louisiana's DMV.

    A. As a new Louisiana resident, you are required to transfer your out-of-state driver’s license to Louisiana within 30 days.

    It is talking about a driver's license but I believe the registration applies as well. In fact I believe all states require registration within the first 30 days.

    I live in Louisiana and a guy that I work with moved from Texas to Louisiana and had to transfer his drivers license as well as all of his vehicle registrations within 30 calendar days. He didn't mind doing any of that but what he really didn't like was the fact that Louisiana made him pay state taxes on everything that he brought with him. He had to pay Louisiana taxes on his two new cars, truck, travel trailer, and boat before he could get any of them registered in Louisiana. Louisiana WILL get their money one way or another.

    I am still waiting on my import documents from my dealer before I can start the process of trying to get my 94 Climber legal for the road.

    The OK thing may be another angle. Once you get a title our state (La) won't care where the title comes from. The challange seems to be the import documents. Once you turn these into a title who cares?

    I live in La, right on the Ms. state line. I had 32 yrs of experience with LSP. Being that close to Ms, there was a large % of out-of-state veh. La. has required liability for a long time. Ms. mandatory liability came along later. During the time period where Ms. did NOT require liability, it was quite common to find La. owners driving Ms registered veh. to avoid the necessary ins. cost. Duh...........We caught many of them. Those that did not take care of the problem after a warning or ticket, had their veh. towed and stored on the next contact.

    Now come the mini Jap. trucks. They do not blend in like a Toy car or Chevy p/u...........they really stand out and they will get the attention of LEO. Since most Troopers work their home area, they will be familiar with the minis and probably the owners. They WILL be checked out. If ole Joe Blow lives on BF Road and is driving an OK lic. mini, he will be REQUIRED to reg. it in La...........That is just the way it is.

    BTW, this is not intended to be an argument, but rather to set the record straight, and give a 'heads-up' warning. There MAY be a chance of reg in OK, then transfer to La, after paying the tax. There is practically NO chance of continually driving it in La. with OK plates


    Any veh. that is used in La. at least 50% of the time, must be reg. here. ALL La. residents must register all of their in state veh. in La.
    Very often, veh coming from another state are required to be physically inspected, verifying that all the paper work jives with the vehicle. Usually it requires a Troopers inspection. Foreign vehicles surely will need a physical inspection.

    I am with barneyrb on this one, why can't I title the truck in a another state than tranfer the title here? I moved down to LA from WA a little over 3 years ago and when I transfered my title, reg., and DL I just went down to the DMV and payed my taxes. no inspection (except the state yearly inspection) and no hassel. besides if they do inspect my truck I would have no worries that it would pass with flying colors.
    For those who care: I haven't gotten any info on the BOL yet, I just replyed back from the import office about a cert. so we will see where that goes.

    If all else fails, try the out of state method. All it will cost you extra will be the out of state registration. But believe this: I have personally had to perform many phy. insp. on vehicles from out of state, and most esp. if they were imported used. Most pass............some don't.

    The option of leaving it registered in another state, will not work.

    here's the problem with registering a vehicle out of state. the state you are driving it in isn't getting their fair share of road taxes. i have seen cases where they will assess back taxes and fees for the time you had it in the state it was not registered in... it happened to me. 2 years worth of registration and taxes. the worst thing about it, was it was a vehicle i left with my exwife in california when i moved to arizona. but none the less, it was in my name and i had 30 days to register it.

    if you are going to register it out of state, i would would find a friend in the other state (fellow mini truck enthusiast, perhaps). "sell" them the truck, let them register and title it then have them "sell" it back to you. no money ever changes hands, it's just a big paper work shuffle. when all is said and done, you have a legitimate title and a bill of sale from an upstanding citizen in a neighboring state.

    it works, trust me ;)

    If the State inspection is what is worrying you....I used to go to a place with registration and insurance card and get a carry out sticker. It is only a $10 TAX our state can collect. :frustration:

    After 3 phone calls to the DMV everytime them telling me that a supervisor was going to call me back and never did. on the fourth call they tell me they are not registering them due to not passing safety standards.

    Yet another law in LA that is a total waste.

    did you know it is still illegal to perform oral sex in LA??

    Radar i bet it isnt. Ask your wife if it is, hehe. Bring your title to Oklahoma and let a Okie get a Okla tag and then drive it back home or best yet just move to Oklahoma.
